DigitalPublic SaaS Terms

1. Operator and subject

DigitalPublic is provided by CENTRO PUBLICIDAD ELECTRÓNICA ESPAÑA, S.L., Spanish tax ID B53449120. These terms govern the portal, API, MCP, Sandbox, plans, connections, support, and billing of the professional service.

2. Account and authority

The customer must provide accurate data, protect access, and have authority over connected accounts, projects, content, and providers. It is responsible for instructions issued by its users and authorized agents.

3. Subscription, renewal, and tax

Paid plans are billed monthly in advance and renew automatically until canceled. Amounts are displayed in EUR or USD and taxes apply according to location and law. Stripe processes payment and provides the billing portal.

4. Cancellation and changes

The customer may cancel for the end of the current period. Unless required by law, partial periods are not refunded. Plan, quota, or price changes will be shown before applying and will respect legally required notice.

5. Plans, quotas, and permissions

Each plan limits projects, users, modules, units, and maximum permission. Exhausted quotas may limit requests. Write is available only on compatible plans and connections with sufficient authorization. Sensitive operations may require human approval.

6. Suspension

DigitalPublic may suspend all or part of the service for non-payment, unlawful use, security risk, abuse, rights infringement, persistent resource exhaustion, or breach. When reasonable, notice and an opportunity to remedy will be provided.

7. Providers and availability

The service depends on Cloudflare, Stripe, hosting, email, databases, AI models, and connected providers. Their APIs, reviews, limits, and changes may affect features. No general SLA is published unless specifically agreed.

8. Outcomes and agent continuity

DigitalPublic does not guarantee traffic, leads, sales, ROAS, rankings, or outperformance of bidding systems. It does not provide advertising budget. It does not host an autonomous agent or promise 24/7 campaign monitoring. Continuity depends on the connected runtime, although scheduled tasks and publications are available.

9. Data, DPA, and ownership

The customer retains its data and materials and grants permissions needed to provide the service and connect providers. Processing on the customer's behalf is governed by the DPA. DigitalPublic branding, software, documentation, and structure remain owned by the operator or licensors.

10. Liability and law

Each party is liable under applicable law and any validly agreed limits. Nothing excludes liability that cannot be limited. The terms are governed by Spanish law and competent courts are determined under applicable rules.
